Please read these Terms carefully. This is a general template drafted to cover how The Mystic Brewer works; it is not tailored to any specific jurisdiction. The Mystic Brewer recommends having a qualified attorney review and adjust these Terms for your location before relying on them.
By accessing or using The Mystic Brewer ("The Mystic Brewer," "we," "us," or "our") at any web address where these Terms are displayed (the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, whether or not you register as a user. If you do not agree, you may not access or use the Site. We may revise these Terms at any time; the version posted on the Site applies as of its "Last updated" date. Your continued use after changes constitutes acceptance of the updated Terms.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the paid, booking, selling, or messaging features. You may register for a free account using the sign-in methods we offer. You are responsible for safeguarding your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. We may suspend or terminate accounts that violate these Terms or that we believe are fraudulent or harmful.
The Mystic Brewer is a marketplace and directory connecting seekers with independent spiritual guides ("Guides") and local metaphysical businesses ("Shops"), and offering crystal reference content, tarot, horoscopes, giveaways, a journal, and related features. We provide the technology and payment processing, but Guides and Shops are independent contractors, not employees or agents of The Mystic Brewer. We do not endorse, guarantee, or warrant any Guide's or Shop's offerings, and we are not a party to the service or sale between you and a Guide or Shop. The Shop directory and all shop, sponsor, and promotional placements are reserved for genuine local shops and small businesses. Wholesale-only websites, bulk distributors, importers, and similar non-retail suppliers may not be listed, advertised, or promoted anywhere on the Site.
Guides offer and price their own services, availability, and booking terms. When you request a booking, the Guide may confirm, decline, or propose alternative times. Bookings and payment are handled through the Site and our payment provider ("Base44 Payments"). Sessions are for spiritual guidance and entertainment only and are not a substitute for professional medical, psychological, legal, or financial advice. Never delay or disregard professional advice because of a reading or content on the Site.
Guides may sell physical products (crystals, candles, jewelry, tarot decks, etc.) through their profiles. The selling Guide is the seller of record and is responsible for the accuracy of product descriptions, fulfillment, shipping, and returns. We collect payment and remit the guide's share after deducting our commission. Any shipping issues, defects, or return requests should be directed to the Guide through the Site, and we may assist in good faith. We do not guarantee delivery times set by individual Guides.
Payments are processed securely by Base44 Payments. The applicable price, commission rate, and currency are shown at checkout. Charges under the minimum permitted by our payment provider are not allowed. If a Guide cancels a confirmed booking before the session, you are entitled to a refund. If you cancel, refund eligibility depends on the Guide's stated policy shown on the booking request. Refund requests for products follow the selling Guide's return policy. We may issue refunds at our discretion for clear non-delivery or platform error. We will never be liable for a Guide's failure to deliver a service outside of our payment flow.
Guides may purchase subscription tiers (e.g., Pro, Premium), featured profile placement, featured shop placement, featured giveaways, and magical theme upgrades ("Promotional Purchases"). These are billed in advance, take effect on approval of your payment, and remain active for the purchased period. Promotional Purchases are non-refundable once activated, except where required by law. They do not guarantee any specific number of bookings, sales, or views. Prices and features may change; changes apply prospectively.
Giveaways are promotions hosted by Guides or by The Mystic Brewer and are void where prohibited. No purchase is necessary to enter unless a purchase is the only entry method and the contest is structured lawfully. Odds depend on the number of entries. Prize fulfillment is the responsibility of the hosting Guide; The Mystic Brewer is not liable for unfulfilled prizes, although we will assist in good faith. By entering, you agree to receive communications related to the giveaway.
The Site allows messaging between seekers and Guides. You agree to use messaging lawfully and respectfully and not to send abusive, harassing, defamatory, sexual, unlawful, or commercial-solicitation content. You are solely responsible for your interactions with other users; we screen messages only to the extent required to operate the platform and to comply with our policies and the law. You may not take contact off-platform to evade fees or protections.
You may post reviews, profile details, messages, and other content ("User Content"). You retain ownership of your User Content, but you grant The Mystic Brewer a worldwide, royalty-free, transferable license to host, store, use, display, reproduce, and adapt it to operate and improve the Site. You represent that your User Content does not infringe the rights of any third party and is lawful. Reviews must reflect genuine experience; we may remove or refuse content that we believe is false, harmful, or abusive. Guides may report reviews for review by us.
You agree not to: (a) use the Site for any unlawful, harmful, or fraudulent purpose; (b) impersonate another person or misrepresent your identity or affiliation; (c) harass, threaten, or defame other users; (d) attempt to charge or take payment off-platform for bookings or sales discovered through the Site to avoid commissions; (e) scrape, reverse-engineer, or overload the Site; (f) upload viruses or malicious code; (g) violate the rights of others, including intellectual property; or (h) interfere with security features; or (i) list, submit, or promote wholesale-only websites, bulk distributors, or similar non-retail suppliers in the Shop directory, sponsor spots, or anywhere else on the Site. We may suspend access and withhold funds for suspected violations.
The Site, our journal articles, crystal content, tarot art, name, branding, and software are owned by or licensed to The Mystic Brewer and protected by intellectual-property laws. You may not copy, redistribute, or create derivative works from our content without permission, except to share brief excerpts with attribution and a link back. User Content remains owned by its creator subject to the license above.
We may display advertising, including Google AdSense, and link to third-party websites and services. We are not responsible for the content, policies, or practices of advertisers or third parties. You acknowledge that third parties may use cookies under their own policies. A Guide's PayPal.Me or external payment link is a third-party service; any dispute with that provider is between you and them.
The Site and all content, readings, horoscopes, tarot draws, and crystal suggestions are provided for spiritual guidance and entertainment purposes only. Nothing on the Site is medical, psychological, legal, or financial advice. The Site is offered on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the Site will be uninterrupted, error-free, or secure, or that readings, horoscopes, or predictions are accurate.
To the maximum extent permitted by law, in no event shall The Mystic Brewer, its owners, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or relating to the Site or your use of it, even if advised of the possibility of such damages. Our total liability for any claim arising from the Site is limited to the amount, if any, you paid to us in the prior twelve months, or where no payment was made, to USD $100. This limitation applies even if a remedy fails of its essential purpose.
You agree to indemnify and hold harmless The Mystic Brewer and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your conduct, your violation of these Terms, or your infringement of any rights of another party.
You may stop using the Site at any time. We may suspend or terminate your access or remove content at any time, with or without notice, if we believe you have violated these Terms or the law, or to protect the Site or other users. Upon termination, licenses granted by you survive to the extent necessary to operate the Site. Sections that by their nature should survive — including those on disclaimers, limitation of liability, and indemnification — survive termination.
We respect intellectual property. If you believe content on the Site infringes your copyright, send a notice to us with the information required by the Digital Millennium Copyright Act, including identification of the work, the infringing material, your contact information, and a statement that you believe in good faith the use is unauthorized. We will process valid notices in accordance with applicable law.
These Terms are governed by the laws of the jurisdiction in which the Site operator is established, without regard to conflict-of-laws principles. Any dispute arising from or relating to the Site shall first be attempted to be resolved informally. If unresolved within thirty days, the dispute shall be resolved by binding arbitration in that jurisdiction, and you waive any right to participate in a class action. You agree that the courts of that jurisdiction have exclusive jurisdiction over any matter not subject to arbitration.
Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site you consent to the data practices described there.
We may update these Terms from time to time. Material changes will be posted on the Site. If you have questions about these Terms, contact us through the support channels provided on the Site. Using the Site after changes means you accept the updated Terms.
